If someone sues you….

Don’t ignore it: If you do, courts often infer that you did something wrong. Reply saying that you don’t think you’ve done anything wrong. Even better have a lawyer do it.

Get legal Help: If things escalate hire an IP attorney. Can’t afford it. Clinics at more than 60 law schools across the country offer pro bono services to entrepreneurs with trademark issues.

Settle or Fight:  A lawyer can help you decide based on your specific situation. It may make sense to settle. – if you say, your company is new and there’s not much to lose. If you invested a lot already, you could try working out a settlement that includes the cost of rebranding. Or you could reach a coexistence settlement, where you both keep using the trademark, but with its, or of course you could fight back in court.
